In Riddham Deora v. Union of India, the Rajasthan High Court held that an estranged father’s refusal to give consent cannot deprive a minor of the right to travel abroad under Article 21.
The Court observed that a child’s future and career cannot be held hostage to parental disputes and directed the passport authority to issue the minor’s passport without further delay.
